I understand the techniques and examples provided; however, does Fair Use have anything to do with monetization? Despite the techniques, can creators monetize their content and claim that the use of the borrowed art therein is justifiable as Fair Use?

There is some major YT drama going on between the company RemoveYourMedia CEO and reaction channels right now. A lot of creators are getting hit with what they call "false copyright claims".
The channel NicholasLight turned to his laywers and will not back down from this fight against RemoveYourMedia. This is the biggest copyright/fair use story of the year on YT. If your intrested in making a new video you could! Unless you are the lawyer of course!

That's not true. The only reason popular Channels like PewdiePie avoid copyright claims is because the makers of the shows want to the exposure and what better exposure is there than Pewdiepie? Therefore they have no reason to feed copyright claims to them.

Why say Commentary. Commentary is not a fair use exception. it appears nowhere in the law. It is a myth. Parody is a factor. Commentary is not. Clip length also is not a factor. Total percentage is. For it to be fair use you have to use the least possible percentage of the original. Why are you lying about the law and the one youtube adjacent court case ruling? The videos out there that use 300-500% of the video in short clips can be laid on your shoulders.

Would a old news documentary from 1958 black and white TV would that be copyrighted to that channel that channel? Wanting to show a native Indian giving an explanation of what is to come in New Year.
@fullyoperational316
I really don't see how some channels survive. I see them copy and paste someone else content and put their name on it. Copy and paste someone else video content and then put a popular copyright song on top of it. I would like to protect myself and my channel so thank you for this information.
@NativeBlackAmericanTv
I am considering doing a feature film--with much commentary on different things... does your strategies work for Feature films? And if not all which ones? To be avoided? More likely not to be a problem? The piece I am considering is of a political nature--and might include some well known political folk...who say different things that might should be "questioned" or made fun of? Or turned out with bad results. The "use" would come in as moments in a larger movie... example: say... have a President saying something... and we halt to comment... and maybe show the not so good result of their presented form of action(which did not work out). IE bad outcomes to not so bright ideas... can that be considered "fair use"? A kind of lampoon of a bad idea proposed... as great idea...hen we see bad outcome. Historic example... CUSTER'S LAST STAND... HE'S GUNG HO... FULL OF PI--N' VINEGAR... talkin' smack aboutwhat he's gonna do... then...quick view od aftermath... with hrdes of indigenous tribes, basically--having done to Custer and crew what he crowed about doing to them... FAIR USE...if real in current politics and actions taken.. that bravado expressed led to foolish failure?... FAIR USE?

Hello, in any case video gets monetised whether it is very short, commentary or educational or report or parody, is not it commercial purpose use and automatically non-fair? Author borrows another authors content without permission and gets money, does not the law in USA consider it non fair? The other question is - even if it is fair use will not algorithm just find commercial use of copyrighted content without the analysis of its context and strike each time by default and hinder each time channel growth and monetization even if undone later? My young son wants to make “Rick roll” type of YouTube content. He is using a snippet of copyright music and a well known game character. It’s a 30 second YouTube short but has no commentary. As a parent, he is on to something very funny and entertaining. However, I’m worried it could cost him a copyright strike and since I have my own channel on YouTube, I’m worried he could cost us both an IP ban if he finds himself in trouble with YouTube too many times. Is this a legit fear? I want to lead him in the right direction; following the rules and laws. How does it work with music? Young people are making “covers” of popular songs. Also, can my son use a small clip of copyright music and game character to tease people at the end of his videos? He argues it is a parody and fair use, but he’s just a kid. If you have a link to a video explaining any of my concerns, please let me know. I’ve spent a while trying to gather information to keep him on the right track. Many thanks!🙏

Good stuff and consistent with what I've learned about fair use except for one thing I'm not clear on. When you suggest altering the image, would that be considered making a derivative? And isn't a derivative without consent a violation of copyright? At least that's my understanding. But perhaps in the context of all these other variables being appropriately implemented a derivative makes it more appropriate.

I'm dealing with a copyright case right now where someone used my content. But they we're not using it in a transformative way that was educational or newsworthy in a professional sense at all, it was more inflammatory. They were also showing my content for a very long time, minutes even, for the majority of their video actually. And they monetized their video that used my content throughout their video. They weren't professional about it at all and alluded to the subject in my content being drunk in one video and the other video they were alluded to the subject not telling the truth. Youtube accepted my copyright claim but then they countered. And in the counter they went as far as saying my content was public domain, but it is clearly not which is a misrepresentation in the counters.
@extrachannel-c5p
So if I were making a documentary style video on the history of the revolutionary war and I’m discussing how the British troops started marching to Lexington and I displayed a history channel clip of British troops marching in their American revolution documentary would this fall as fair use? I know you said educational content is a form of fair use to begin with but I didn’t know if that still applied to a monetized YouTube channel since it’s technically no longer a personal use project and more of a commercial use since you receive money from it
