The Constitutional Court has reserved judgment in a legal battle over who holds the power to set South Africa's Value-Added Tax rate.
The Democratic Alliance approached the apex court to confirm a March ruling by the Western Cape High Court, which declared the Finance Minister's unilateral authority to alter the VAT rate unconstitutional.
The party argues that the Constitution assigns tax-raising powers exclusively to Parliament, asserting that Parliament cannot delegate this responsibility to the Executive.
Counsel for National Treasury and the South African Revenue Service is strongly opposing the application, defending the Minister's statutory discretion.
