Landmark ruling on refugee protection laws: Mametlwe Sebei weighs in

The constitutional court today delivered a judgement on Scalabrini's bid for confirmation of constitutional invalidity against parts of sections 4 & 21 of the Refugees Act insofar as they effectively debar foreign nationals who wish to seek asylum in South Africa from doing so, if they hold an adverse immigration status.

The impugned provisions were also attacked on the basis of their allowance for asylum seekers to be returned to countries where they may face death, torture and detention without trial.
