The prosecution in the trial of the six men accused of the murder of 18 people in Lusikisiki in 2024 has completed its argument in opposing the Section 174 application by accused number 1, Mzukisi Ndamase, the alleged mastermind of the mass murder.
A Section 174 application under the Criminal Procedure Act is a formal request to the court to acquit an accused person at the end of the State’s case.
Ndamase believes he does not have a case to answer, as the Section 204 witness, Lwando Abi’s evidence against him was influenced by hate.
Ndamase says Abi intended to tarnish his name.
In opposing the application, the State, led by Advocate Mfundo Makhubalo, told the court that there is evidence before court that Ndamase ordered the killing of the members of the Sinqina and Matu households which culminated in the death of the 18 people.
