EFF court challenge raises questions about the national fuel levy

An application by the EFF challenging the Finance Minister's authority to determine and adjust the fuel levy, will be heard in the Western Cape High court this morning.
The party has argued that only Parliament has the constitutional power to impose or amend taxes. However, minister Enoch Godongwana's defence is that the time involved if Parliament makes decisions about the adjustment of the fuel levy, would be excessive, because parliamentary processes involve public consultation.
He has argued that parliamentary involvement would make the process of adjusting the fuel levy far less flexible and current or immediate.
