The NPA has instituted disciplinary action against prosecutor, Mkhuseli Ntaba, after he failed to appear in the case involving prominent businessman, Joe 'Ferrari' Sibanyoni.
The Kwaggafontein Magistrate's Court heard that a colleague informed the magistrate that Ntaba was on his way, but no timeframe was provided, prompting the court to issue a warrant of arrest in his absence.
The magistrate also ruled that Ntaba's conduct would be reported to the Legal Practice Council, and the Office of the National Director of Public Prosecutions.
As a direct result, the case against Sibanyoni and three co-accused was struck off the roll.
