A juror has the duty to vote after hearing all of the evidence, not every juror will always agree. The defense should be happy with a hold out. Having them removed does not help her.
@DSage-03
@@DSage-03 1 weeks ago
The Judge doesn't get to tell the jurors how to vote.
The judge does not instruct jurors on how to vote; instead, jurors are expected to make their decisions based on the evidence presented during the trial. The judge's role is to ensure the trial is conducted fairly and to provide legal guidance, but the final verdict is determined by the jury's deliberation.

On Friday, the jury returned for a seventh day of deliberations in the case against Lindsay Clancy. Before the jurors entered the courtroom, the defense and judge got into a heated debate over the alleged holdout juror. The defense accused the juror of “lying to the judge,” while the state said it was comfortable with the jury returning to deliberate. The judge ultimately decided to give the jury instructions once again before sending them back to deliberate.

Wow, incredible. The defense wants to replace a juror just because he doesn’t agree with the others. The judge is correct here. “Beyond reasonable doubt” doesn’t mean “beyond any doubt.” It’s shocking that only one person sees defense games.

There was a famous case in Baltimore where they got a conviction but one of the jurors wanted to talk to the prosecutor afterwards about what went down.

When they went in to deliberate and had gotten the preliminaries done and the foreman asked the jurors what they wanted to do already. Eight of the jurors said they didn't care what the vedict was and the other four could debate the issues and they would vote for whatever those four decided. That was 2 and 2 so they argued it out until the 2 who knew they were guilty finally got the other 2 to vote guilty and then 8 jurors true of heart voted along with them.

Remember that if you ever have to go to trial. Most jurors don't care if you're guilty or innocent. They just want to get along and get it over. It isn't 12 angry men. It's 12 people who aren't smart enough to get out of jury duty.

Testimony about the mental competence of a defendant should not be admissible in trials. Psychiatrists testifying about the mental state of an accused person's mind have about as much business as a priest testifying about the religious state of a person's soul in our courts. Insanity was a legal tactic invented to circumvent the punishments of the Church, which at the time included confiscation of the property of those who committed suicide, often leaving widows and orphans destitute. Only an insane person would do such a thing to his widow and children, it was successfully argued. This is legal mercy masquerading as medicine, according to Szasz.[24]

Sadly, if it doesn't end today, I would not be surprised if the defense tried to "sand bag" the juror. What I mean is - Over the weekend, have some "random" person approach the juror (like the reporter said, it's being discussed everywhere in town) and say something like, "Wow, crazy about the neighbor's DNA being found on scene, isn't it?" or some other "contact" that will "prejudice" and disqualify the juror. Seriously, consider the possibilities. Hopefully, they won't let it go on past today. That jury should have been sequestered!
