This is the only clip of the Judge and the trial I’ve seen really. But from this alone I understand why the jury are stuck. The judge seems to bad with words. His instructions are overly wordy and technical. Other judges would give the technical terms but then also give a simple explanation. And come on not everyone in a jury will understand half of the large words he just said.

I really don’t see this case or any similar case resulting in anything but a hung jury. Even if that case lacked the well documented fact the mother was not mentally well, had been trying to get help over the course of a long period of time and was clearly not properly treated (held in the psych ward rather than being allowed to self-discharge) and her doctors not checking medical records to see what meds she’s already on via other doctors. Especially given she was on a ton of meds, had meds added and removed multiple times as well as dosage changes and the fact she was misdiagnosed and given medication that would never be given to someone with her diagnosis because that drug only will make the condition worse. A case where the investigation was so poorly done / virtually not done because police said they solved it immediately thus no further investigation was needed. A case where the prosecution did such a poor job. A case where the prosecutions theory rested on such a precise timeline that clearly doesn’t add up and their star witness can’t provide a good explanation as to why the timeline (a timeline put together primarily based on what he told police) didn’t match the evidence. A case where what should have been a suspect was only treated as a witness. A case where the defenses witnesses came off as honest, have track records of being witnesses for both defense and prosecutions in the past, had been treating the patient from the day this happened or shortly after until shortly before or up until the trial. A case where even the father and grandparents from both sides admit to what a great mother she was and how she had been spiraling and trying to get help. A case where the accused was a well respected and caring nurse. A case where the police were so inept that they not only had no answers for why blood splatter didn’t make sense when looking at the rest of the scene (blood splatter, droplets to be exact, ended up under furniture that had not blood on it. Heavily implies someone moved things around the crime scene with zero reason for stuff in that area to have been moved around after the fact (no bodies in there, no need for first responders to need to move stuff to reach a victim and no mention from the only person at the scene of having moved it / never being told evidence showed this and asked if he forgot to mention something and or why he neglected to mention it / reason for moving said items before police arrived). A case where it appears the husband was having an affair. Fairly quickly remarried, brought that women to his children’s memorial services, had been taking “work trips” into the city he moved into shortly after the with the new wife. Rents an apartment from the new wife’s father, an apartment that should be beyond their means. Fact he cashed in on three life insurance policies, ran a go fund me within days of this happening where he says he immediately forgives her and is raising money (a lot was raised) to cover his wife’s defense (he didn’t pay for her lawyer) and the other portion for his children’s services (often times funeral directors / homes will either give a massive discount or free services when it comes to children and or victims of such horrific crimes and Mass has a fee collected from pretty much anyone that is arrested and finds themselves in front of a judge called the victim impact fee. I had to pay it when I was arrested for driving with a suspended license even though the case was dropped because I paid the unpaid ticket that caused it to be suspended and got it reinstated within 30 days. I wasn’t found guilty, no probation, no record, no other fees or fines and no victim. This money collected via this fee is often used to cover expenses of victims of horrible crimes IE funeral costs. If what was reported is true.. he only bought a single headstone with all three children listed.) and has yet to disclose what the money was actually used for AND he has brought wrongful death lawsuits against a bunch of doctors / hospitals… but not his wife. His mother refused to attend the wedding and testified in defense of the woman who killed her three grandchildren. He was also caught being dishonest to either police or in his testimony. He said he was doing CPR until paramedics arrived… but they said he was sitting in a couch or something when they arrived. He said she confessed to him even though she’s only making groaning noises as he’s talking to her and 911. He’s the only reasons cops knew there were crushed up pills in her lemonade (which would be used to mask the flavor of drugs. That would more often be seen in a case if some being drugged. She could have just swallowed them all). He said he couldn’t call 911 because the phone was connecting to wifi which was out (I work at a cell phone company and a 911 call will go through even with no service or wifi calling). Her core body temp was way lower than it should have given the timeline the state laid out which suggests she was outside much longer they could have been the case according to the timeline. She was soaking went on a cold winter day and there was a hose hooked up close by which is odd to have a hose left out and connected during winter. The fact she said she did not remember anything when she woke in the hospital and it appears she was told by her husband and then police she did this and admitted it to her husband before losing consciousness. I’m not saying he did it. It could very well be the trauma caused him to not have a great grasp on times and what not. But the states case is partly based on the claim she is guilty because the timeline shows she planned it perfectly and that methodic planing and execution of her plan shows she was legally insane. But I am saying given all of this it leaves room for reasonable doubt. And other weird things. I’m not saying he did it given case with other things that leave you scratching your head like why a nurse was googling things like “where the carotid artery is located among other things. I could go on and on in regards to the disaster this trial has been and the fact all the evidence and testimony of those around her shows she was a good, caring, loving and hardworking mother, wife and nurse. The fact even the state concedes to the facts she was having serious mental issues, was seeking help over a decently long period of time, was vocal about some of her dark thoughts, had called the suicide hotline and even tried to have herself admitted to a psych ward, but was quickly discharged. Also the states witnesses were a disaster. One had to resign his position because his testimony showed he was not fit for the position, one or more are connected to a group that always testified for the state and have only deemed one person not mentally competent once and had lied in a prior trial which resulted in an appeal to be filed and a new trial ordered. Their witnesses didn’t actually interview her somewhat recently if I remember correctly so they didn’t interview her right after and in the following months or even years. <br><br>Through all of that out and assume none of these issues existed. I still don’t see a group of 12 people all being able to believe a mother could do this to her three children and then attempt to take her own life unless she was legally insane at the time. I also don’t think you’ll get 12 people to all agree she isn’t guilty due to insanity. Or even if she was insane she shouldn’t be criminally held responsible for what happened and deserves life with no parol. The jury are people and are given jury instructions. It doesn’t mean everyone will follow said instructions because they feel so deeply one way or the other. I just don’t see it ever happening. I think the only way we will ever see a resolution is if the plea deal is reached.

Why doesn’t the judge make the decision alone? In my country, we don’t have a jury, so the judge makes the decision. In a system like this, what exactly is the role of the judge? I’m not in the legal field, so I’m genuinely curious. Maybe someone who works in law can explain it.

I went through psychosis as well (not after having a child though) and it felt so real to the point where I called the cops. It wasn’t till my neighbors said they didn’t hear nor see anything and then my landlord ran the cameras and it was NOTHING. Scared the mess out of me. But I sought help. My psychologist at the time was saying how I was under a lot of stress juggling two full time jobs and college. <br><br>However, when I had my baby I fell in postpartum depression so badly. I didn’t feel connected to her until it was a snow storm and my child’s father wanted to be out with another woman. My house’s central air went out and we were in the cold for days. And depending on the severity of it is okay to tell people I need help. I need you to watch out for my child. I need you to watch out for myself. But I think it’s harder to do when you are married but yet feel like a single mother. When she was almost one people started asking when we were going to have another child and I would get so agitated. I went through hell by myself while he did whatever he wanted. So I DO feel bad for her that she had kids back to back knowing her husband wasn’t a supportive partner. I have a real problem with a ny juror who’d keep their hand down every time the judge asks if they can put the prosecution case being proven beyond RD, the law, jury instructions, a complete investigation, &amp; evidence coming through the trial after their emotions &amp; how they feel about the cut of a defendant’s jib, their belief in religion or what they think happened, a stipulation with someone who has something going on with mental illness, anno of someone who has emotions, the sensitivity of the evidence, even if they don’t understand &amp; or be willing to say they’ve never heard of a case just to get on the jury, swearing they haven’t spoken about the case or seen any media &amp; be willing to send a defendant to prison based on those things, in America.
